Terms and Conditions
1. Information on how to apply for and participate in the Amazon First Nations Business Accelerator (“Accelerator”) from part of these conditions. By participating, recipients agree to be bound by these conditions. Applications must comply with these conditions to be valid.
Eligibility
2. Eligibility is limited to prospective Amazon Australia Sellers that have successfully expressed their interest via Supply Nation during the Promotional Period and meet and maintain the following criteria:
a. The applicant must fully complete all sections of the Expression of Interest (EOI) form at https://connect.supplynation.org.au/amazon/ during the Promotional Period;
b. The applicant must not already be registered to sell on Amazon.com.au;
c. The applicant must hold an active and valid certification with Supply Nation (including being 51% or more Indigenous owned, managed and controlled) – see here for more details about Supply Nation;
d. The applicant must have an existing physical consumer product that is available for sale to the public at the time of application and is suitable for sale on Amazon.com.au in accordance with Amazon’s policies including, without limitation, the Restricted Products Policy and the Amazon Anti-Counterfeiting Policy;
e. The business representative for the applicant must be 18 years or older at the time of applying for the Accelerator;
f. The applicant’s headquarters must be based in Australia;
g. The applicant must be a small business (namely, employ fewer than 100 people or have generated less than AUD$10 million in aggregate annual revenue); and
h. The applicant must possess a valid trade mark registered with IP Australia for their product’s brand.
3. Employees and their immediate families of the Promoter or its affiliates, and its agencies are ineligible to enter.
4. The offer commences at 12:01am AEST on 29 August 2024 and closes at 11:59pm AEDT on 15 October 2024 (“Promotional Period”).
How to Apply
5. To apply for the Accelerator, visit https://connect.supplynation.org.au/amazon/ and express your interest in the Accelerator by fully completing all sections of the form during the Promotional Period. You will be notified in writing if your application is successful.
6. Limit applies of one (1) application per applicant business.
Judging
7. All applications will be judged individually on their merits by Amazon’s internal category experts along with feedback from Supply Nation and Export Accelerator (“EA”), on 31 October 2024.
8. The best 25 applicants, as determined by the judging panel, will each participate in the Accelerator (“Recipients”). Recipients will be notified in writing within 10 business days of the judging.
Accelerator package
9. Each Recipient will receive an Accelerator package over a 3-month period (“Accelerator Period”), worth up to AUD$9,578. Each Accelerator package consists of the following to be provided over the Accelerator Period:
o Launch services provided by EA:
o Amazon Seller account setup
o Product* listing creation – title, description, bullets
o Product* Image optimisation (5-6 images incl infographics)
o Amazon A+ content for all products*
o Amazon brand storefront setup
o Support sending your first shipment to Amazon
o Fulfilment by Amazon (FBA) prep and labelling
o Inventory recommendations
*Up to 20 parent products
o Growth service provided by EA:
o Account management support
o Support to create and launch sponsored advertising campaigns
o Support across advertising and account management
o Amazon deals and promotion support
o Monthly reporting and insights
o Monthly catch-ups to monitor performance
o Amazon Ads credit
o A budget of up to AUD$1,000 in Amazon Ads credits to execute an Amazon Ads strategy during the Accelerator Period

10. The Accelerator package is provided by EA, a third-party service provider, and is subject to applicable terms and conditions of EA. Any questions, comments or concerns regarding the provision of EA’s services must be directed to EA.

11. The start date of the Accelerator Period will be communicated in writing to each Recipient.

12. Recipients are not obligated to engage EA following the completion of the Accelerator Period.

13. The value of the Accelerator package is accurate and based upon the recommended retail value of the individual components (inclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the Accelerator after that date.

14. All taxes (excluding GST) which may be payable as a consequence of participating in the Accelerator are the sole responsibility of the Recipients. All other ancillary costs including but not limited to insurance and taxes (excluding GST) and other expenses are the responsibility of the Recipients. The Promoter accepts no responsibility for any tax implications and recommends that applicants seek their own independent financial advice relating to acceptance of the Accelerator package.

15. Accelerator packages are not transferable and are not redeemable for cash. The Promoter’s decision is final and binding – no correspondence will be entered into.

16. Each Accelerator component provided by EA is subject to the terms and conditions of that third-party service provider and the provision of such components is the sole responsibility of EA and not the Promoter. The Promoter accepts no responsibility or liability for any delay or failure by the third-party provider to deliver the Accelerator component, any delay or failure relating to the applicable Accelerator component itself or failure by the third-party provider to meet any of its obligations in these Terms and Conditions.

17. To the extent permitted by law, the Promoter assumes no responsibility for any failure to receive an application or for inaccurate information or for any loss, damage or injury in connection with the conduct of the initiative whether as a result of:
a. technical or telecommunications problems, including security breaches, technical website malfunctions or glitches; or
b. acts or omissions (including negligent acts of omissions) of the Promoter's servants or agents involved in the conduct of this initiative.
In the event of such problems or conduct, the Promoter may modify, cancel, terminate or suspend the offer.

18. It is a condition of accepting the Accelerator package that Recipients agree to participate and cooperate in all reasonable media relating to this initiative including interviews, photography, and filming. Each Recipient agrees that the Promoter has a royalty free, perpetual license to use, reproduce, edit, communicate to the public, and adapt all material provided to the Promoter as part of the initiative, on or in connection with any media. Each Recipient agrees to sign any further documentation required by the Promoter, such as a talent release, to give effect to this arrangement as a precondition to participating in the Accelerator. To the extent permitted by law, entrants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their application.
Verification
19. The Promoter reserves the right to request verification of any information that has been provided by or on behalf of the applicants relevant to the application for or participation in this Accelerator.

20. The Promoter reserves the right to disqualify applications and/or Recipients that do not comply with these Terms and Conditions. The Promoter also reserves the right to disqualify any applicant who provides false information, fails to provide information, conspires with others to gain an unfair advantage or is otherwise involved in any conduct that involves manipulating, interfering or tampering with this initiative or otherwise preventing the conduct of the Accelerator as intended by the Promoter. In the event of such problems or conduct, then the Promoter may modify, cancel, terminate or suspend the Accelerator.
Promoter’s Liability
21. The Promoter shall not be liable for any loss, damage or injury suffered by any Recipient as a result of the Recipient accepting and/or participating in the Accelerator, except for any loss, damage or injury which is due to the gross negligence or criminal misconduct of the Promoter or which otherwise cannot be excluded by law. The Promoter will not be liable for any consequential or incidental damages.

22. Participation in the Accelerator does not guarantee any business outcome, such as sales.
Representations and Warranties
23. Each applicant represents and warrants that:
a. its products, including packaging: (i) comply with all applicable laws and Amazon policies; (ii) do not and will not infringe any intellectual property, privacy, publicity or other rights of any third party; and (iii) do not contain any sexually explicit (except to the extent permitted by Amazon’s Program Policies), offensive defamatory or obscene materials;
b. the applicant and its representatives must at all times act with due regard to public morals and conventions and must not behave in a manner that brings themselves into public disrepute, scandal, contempt or ridicule or that shocks, insults, or offends a substantial portion or group of the community or reflects unfavourably on the Promoter or its products and services;
c. it has full authority to grant the Promoter the rights referred to in these Terms & Conditions; and
d. it will indemnify the Promoter against all loss, damage and liabilities arising from a breach of any of the warranties in these Terms & Conditions (except for any loss, damage or liability which are due to the gross negligence or criminal misconduct of the Promoter).
General
24. Any dispute relating to whether applications have been received or not will be determined by the Promoter, whose decision is final. Any application that contains content that the Promoter reasonably considers to be incomplete, inaccurate, underage, erroneous, ineligible, offensive, misleading, inappropriate or incomprehensible will be deemed invalid, as well as any application that the Promoter reasonably considers to infringe any intellectual property rights or other rights of any person, corporation or entity.

25. Applicants agree that they are authorised to apply for the Accelerator on behalf of the business they are representing.

26. Except as otherwise provided for, all amounts contemplated in these Terms and Conditions, including Accelerator package values, are expressed in Australian Dollars.

27. The Promoter’s failure to ensure strict performance of any provision of these Terms & Conditions will not constitute a waiver of the Promoter’s right to enforce such provision or any other provision of these Terms & Conditions subsequently.

28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth).

29. Participation in the Accelerator is subject to the Amazon Services Business Solutions Agreement.

30. This notice should be read in conjunction with our Privacy Policy, which contains information about how we handle your personal information (including personal information collected via our website) and how to contact us if you have any questions about our management of personal information. Applicants may access, and obtain a copy of the Promoter’s privacy policy by visiting https://www.amazon.com.au/gp/help/customer/display.html?ie=UTF8&nodeId=468496&ref_=footer_privacy. The Privacy Policy contains information about how applicants may access, update or correct their personal information, how applicants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter may disclose applicant’s personal information to entities which operate outside of Australia

31. The Promoter is Amazon Commercial Services Pty Limited (ABN 30 616 935 623) of Level 37, 2 Park Street, Sydney, NSW 2000, Australia.

32. The third-party service provider is Export Accelerator (ABN 26 390 669 201) of Level 2, 194 Varsity Parade, Varsity Lakes, QLD 4227, Australia.
